The claim of the petitioners is that the petitioners were assigned the subject land to an extent of Ac.1.97 cents in Sy.No.37/2 in favor of petitioner No.1 and Ac.1.04 cents in Sy.No.37/1 in favor of petitioner No.2of Thirunampalli Village, Penagaluru Mandal, Konduru, Annamaya District. In view of the complaint made by the MLA Railway Koduru, the 2"^^ respondent herein passed an order dated 26.03.2025 that the petitioners not granted pattas as contended by them. Therefore, the 3. were Tahsildar directed to resume the land to the Government under proper panchanama and after following due process. Hence, the present writ petition. On the other hand, learned Assistant Government Pleader 4. submits that the order impugned dated 26.03.2025 passed by the 2^^^ respondent is applicable before the commissioner of appellate, and if the petitioners prefers an appeal, the same would be considered in accordance with law. Having regard to the submissions made by learned counsel 5. for both parties and the material on record, this court is of the opinion that the writ petition can be disposed of directing the petitioner herein to submit a statutory appeal before the appellate authority within a period of four (04) weeks from the date of receipt of copy of this order. On such submission, the appellate authority shall consider the same in accordance with law and pass appropriate orders after providing an opportunity of hearing to the petitioner as well as stock holders if any, within a period of six (06) months thereafter. In the meantime. Status Quo obtained as on today in respect of the subject property shall be maintained by both parties. m t With the above directions, the writ petition is disposed of. 6. No costs.
