This petition has been filed with the following prayers :- (i) issue a writ, order or direction in the nature of Certiorari to quash the notices dated 20.02.2025 passed by Opposite party no.4 for removal of encroachment in Land Gata No.353, area 0.070 hectare situated at Village Pure Khushai, Pargana and Tehsil Sadar, District Pratapgarh (Annexure No.1), in the interest of justice. (ii) issue a writ, order or direction in the nature of Mandamus commanding the Opposite parties particularly Opposite party no.2 and 3 to ensure the peaceful possession of petitioners over the Land Gata No.-353 area 0.070 hectare situated at Village Pure Khushai, Pargana and Tehsil Sadar, District Pratapgarh (contained as Annexure no.2 and 3), in the interest of justice. Heard learned counsel for the petitioners, learned Standing Counsel and Shri Pankaj Gupta who appears for the gaon sabha. We have gone through the notice issued by the lekhpal copy of which has been filed as Annexure -1 to the petition. It is evident that some inquiry was carried out with respect to land of Gata No.353, area 0.070 hectare wherein it was found that there was encroachment made by the petitioner, tenants Madeena Begum wife of Mohd. Shafeque. A notice has been issued to the tenants of the petitioner to remove such encroachment against which this writ petition has been filed.
