HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 9506 of 2025 Court No. - 6 HON'BLE JASPREET SINGH, J. Heard learned counsel for the petitioner. Notice on behalf of respondent nos. 1 to 3 has been accepted by the office of the learned Chief Standing Counsel for the State-respondents. Sri Pancham Srivastava, learned counsel who has put in appearance on behalf of respondent no. 6 on caveat, had raised an objection regarding the maintainability of the instant petition. It is urged that since the order had been passed in proceedings arising out of Section 24 of the U.P. Revenue Code, 2006 relating to the demarcation whereby the appeal of the petitioner has been dismissed. He still has a statutory remedy of filing an appeal. The learned counsel for the petitioner after arguing at some length submits that he may be permitted to withdraw the present petition with liberty to take recourse to the provisions of revision as may be applicable. Accordingly, the present petition is dismissed with the aforesaid liberty. It is made clear that mere dismissal of the petitioner may not be construed as an expression of opinion on merits of the matter and in case if the petitioner files the revision, the same shall be considered on its own merit strictly in accordance with law.
