The petitioners are arraigned as accused Nos. 2 to 5 in C.C. No.1181 of 2024 on the file of the Special Judicial Magistrate of First Class Trying Prohibition and Excise Cases Machilipatnam, for the alleged offences under Section 85 of the Bharatiya Nyaya Sanhita, 2023, and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. The first petitioner is the mother, the second petitioner is the brother, and the third petitioner is the sister of accused No.1. The fourth petitioner is the husband of the third petitioner. 3. On 06.05.2025, this Court granted stay of appearance of the petitioners and ordered notice to the second respondent. 4. Today, the learned counsel for the second respondent is present. The learned counsel for the petitioners sought to dispose of the criminal petition. 5. Though the petitioners filed the present criminal petition seeking to quash the proceedings in C.C. No. 1181 of 2024 pending against them before the Special Judicial Magistrate of First Class Trying Prohibition and Excise Cases, Machilipatnam, the petitioners requested to dispose of the criminal petition by dispensing with their presence in the C.C. 6. The learned counsel for the second respondent has expressed no objection to the relief sought by the petitioners. -3- CRLP_5132_2025 7. Considering the submissions, this Court is inclined to dispose of the criminal petition by dispensing with the presence of the petitioners in C.C. No. 1181 of 2024 pending against them before the Special Judicial Magistrate of First Class Trying Prohibition and Excise Cases, Machilipatnam, except for the dates on which the petitioners are required to be present, for the purpose of trial. It is left open to the petitioners that the contentions raised in the quash petition can be raised before the trial court when the matter is taken up for trial. 8.
