This petition has been filed with the following prayers :- "issue a writ, order or direction in the nature of mandamus commanding the opposite party no.2, 3 and 4 to take proper action against respondent no.5 for not to create any hindrance in peaceful fisheries of petitioner allotted after due process of law." It is the case of the petitioner that the petitioner participated in auction proceedings held by SDM Tanda Ambedkar Nagar with respect to pond situated in Gata No.1060 Minjumla, area 0.727 hectare situated at village - Vajdahiyapaipur, pargana Bidhar, Tehsil Tanda, District - Ambedkar Nagar. The respondent no.5 filed an appeal no.975/2023 before the Collector which was rejected by order dated 10.11.2023. Despite such rejection of appeal, respondent no.5 continued to occupy the pond in question and is not letting the petitioner to do fishery in the same. We have gone through the instructions sent by the Sub Divisional Magistrate Tanda, Ambedkar Nagar produced by the learned Standing Counsel from which it is evident that FIR No.253/2025 under Section 64 (1) of the BNS has been lodged on 24.8.2025 against respondent no.5 and he has been sent to District Jail Ambedkar Nagar where he is in custody.
