HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW MATTERS UNDER ARTICLE 227 No. - 5856 of 2025 Court No. - 7 HON'BLE JASPREET SINGH, J. Heard learned counsel for the petitioner. In view of the order proposed to be passed, notice to the private respondent is dispensed with. By means of the instant petition, the petitioner seeks very limited relief that the Matrimonial Case No.3437 of 2022 filed under Section 13 read with Section 27 of the Hindu Marriage Act and pending before the Court of learned Additional Principal Judge-III, Family Court, Lucknow, be decided expeditiously. It is contended by learned counsel for the petitioner that the said case was filed in the year 2022 and despite service of notice upon the respondent, the written statement has not yet been filed. The petitioner has also moved an application under Order VIII Rule 10 C.P.C. on 25.10.2023, a copy of which has been brought on record as Annexure No.2 to the writ petition, stating that neither the said application has been decided nor any effective order passed and in a mechanical manner, time is being granted to the respondent for filing the written statement. In the aforesaid circumstances, it is prayed that the proceedings be expedited. Considering the aforesaid, this Court is of the view that no gainful purpose would be served; rather the ends of justice can be met by directing the court concerned to take note of the Division Bench decision Versus Counsel for Petitioner(s) : Rakesh Kumar Shukla, Anjaly Sharma, Pragya Pandey Counsel for Respondent(s) : Savita Maurya .....Petitioner(s) Akhilesh Prasad Maurya .....Respondent(s) of this Court in Prabahat Narain Tickoo vs. Mrs. Mamta Tickoo and others reported in 1988 SCC OnLine All 327 and pass appropriate orders.
