PRAYER: Civil Revision Petition is filed under Article 227 of Constitution of India, to set aside the order passed in I.A.No.5 of 2025 in O.S.No.615 of 2013 dated 23.09.2025 on the file of the Principal District Munsif Court, Thirumangalam and to allow the Civil Revision Petition. For Petitioner : M/s.P.Yasmin Begum
ORDER The instant Civil Revision Petition has been filed to set aside the
order passed in I.A.No.5 of 2025 in O.S.No.615 of 2013 dated 23.09.2025 on the file of the Principal District Munsif Court, Thirumangalam. 1/6 https://www.mhc.tn.gov.in/judis

2. This Court, by order dated 24.09.2025, recording the statement made by the learned counsel for the petitioner had granted an interim stay of further proceedings of the suit in O.S.No.615 of 2013. This Court had inter alia directed the Registry to call for report from the Principal District Court, Thirumangalam, with regard to the averments made by the
learned counsel for the petitioner. 3. A report has also been placed before this Court, as received from the Principal District Munsif Court, Thirumangalam. A perusal of the report indicates that the Court after hearing both sides had pronounced orders dismissing I.A.No.5 of 2025. However, the Court Typist had erroneously updated that the petition had been closed, which came to his knowledge on 24.09.2025 and the erroneous update was corrected on the very same day. Further, a memo had been issued by the Court calling for an explanation from the concerned Court Typist. 4. When the matter was taken up for hearing on 17.10.2025, this Court adjourned the matter by four weeks. 5. This Court during the Diwali Holidays verified the e-portal of the Principal District Munsif Court, and found that on 23.09.2025, a 2/6 https://www.mhc.tn.gov.in/judis
C.R.P(MD)No.2787 of 2025 speaking order dismissing I.A.No.5 of 2025 had been uploaded in the e- portal at 6.11 p.m. and a modification had been made at 6.13 p.m. Hence, the Registry was directed to list the instant civil revision petition under caption “For Being Spoken to” today. 6. This Court queried the learned counsel for the petitioner as to why the fair and decreetal order had not been challenged and only the B- Diary extract as reflected in the portal had been challenged. The learned counsel for the petitioner submits that the petitioner had not noted the uploading of the order on the same day and therefore, he had challenged the B-Diary extract. 7. The primordial contention of the petitioner is that the Court below recorded that the parties were called absent and closed the enquiry and pronounced the orders. However, on the next day, the said content was revised by modifying it as both sides were heard. She submits that without hearing the petitioner, the petition was dismissed. 8. I.A.No.5 of 2025 was filed seeking an adjournment of the proceedings. It is also to be noted by this Court from the extract uploaded 3/6 https://www.mhc.tn.gov.in/judis
C.R.P(MD)No.2787 of 2025 that the case was posted for trial and had been repeatedly adjourned. A perusal of the order made in I.A.No.5 of 2025 dated 23.09.2025 indicate that the petition filed by the petitioner for adjournment was rightly negatived by the Court below. 9. In view of the same, I do not find any merits in the civil revision petition. Accordingly, the Civil Revision Petition stands dismissed.
10. Considering the fact that the trial has already commenced in the suit, there shall be a direction to the learned Principal District Munsif, Thirumangalam, to dispose of the suit in O.S.No.615 of 2023 as expeditiously as possible but not later than three months from the date of receipt of a copy of this order. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed. 23.10.2025 NCC : Yes / No Index : Yes / No Internet : Yes / No sn Note: Issue order copy on 24.10.2025 4/6 https://www.mhc.tn.gov.in/judis
