(Oral) Applicant Sher Khan seeks anticipatory bail in FIR No. 256 of 2024 dated 21.11.2024, under Sections 329(4), 62, 318(4), 338, 336(3), 340(2), 61(2) of the Bharatiya Nyaya Sanhita, 2023 (120B, 420, 467, 468, 471 IPC), Police Station Rajpur, District Dehradun. 2. Heard learned counsel for the parties and perused the record. 3. According to the FIR the applicant and the co-accused wanted to grab the property of one Ritu Mehta. The informant was the caretaker of the property. 4. It has been the case of the applicant that the co- accused having similar role has already been granted ad interim protection by this Court. 5. State was required to file objections. But, it has not been filed. 6. Having considered, this Court is of the view that this is a case, in which the applicant should be granted anticipatory bail. The instant anticipatory bail application deserves to be allowed. 2 7. The anticipatory bail application is allowed. 8. In the eventuality of arrest, the applicant shall be enlarged on bail on his furnishing a personal bond with two sureties, each in the like amount, to the satisfaction of the Arresting Officer (“AO”). In addition to it, the applicant shall also comply with the following conditions:- (i) The applicant shall co-operate with the investigation. (ii) He shall not approach the victim or /and any of the witnesses, in any manner, whatsoever. (iii) He shall not leave the country without prior permission of the court concerned. (iv) He shall deposit his passport with the AO. The passport may only be returned by the order of the court concerned. In case the applicant does not have passport, he shall give an undertaking to that effect to the AO. (v) The applicant shall also give an undertaking on (i), (ii) & (iii) above.
