Heard the parties.
The petitioner has been made accused in connection with Jamtara Cyber Crime P.S. Case No.29 of 2025 registered for the offence punishable under Section 111(2)(b) /317(2) /317(4)/ 317(5)/ 318(4)/ 319(2)/ 338/ 336(3)/ 340(2)/3(5) of the B.N.S., 2023 and Section 66B/66C/66D of I.T. Act.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in cybercrime and was also involved in suspicious transaction amounting to Rs.2,30,664/-. It is next submitted that the allegation against the petitioner is false. It is then submitted that only because two mobile phones with two SIM Card were recovered from the petitioner, hence the petitioner has been implicated in this case. Drawing attention of this court towards para-11 of the instant bail application, learned counsel for the petitioner submits that the petitioner has no criminal antecedent. It is further submitted that the petitioner has been in custody since 15.04.2025 as is evident from para-10 of the instant bail application. It is further submitted that the petitioner undertakes to furnish sufficient security including cash security and also undertakes to co-operate with the trial of the case. Hence, it is submitted that the petitioner be released on bail.
Learned Addl. P.P. appearing for the State opposes the prayer for bail of the petitioner.
Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on depositing cash security of Rs.2,30,664/- and on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Spl. Judge, Cyber Crime, Jamtara in connection Jamtara Cyber Crime P.S. Case No.29 of 2025 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case.
