HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 11344 of 2025 Court No. - 30 HON'BLE MANJIVE SHUKLA, J.
1. Heard Shri Vinod Kumar Pandey, learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
2. The captioned writ petition has been filed by the petitioner assailing therein the order dated 19.07.2022 passed by the Sub-Divisional Magistrate, Rudauli, Ayodhya, whereby major penalty, in the form of withholding of one increment permanently, had been imposed against the petitioner.
3. Learned Standing Counsel appearing for the State-respondents, at the very outset, has raised preliminary objection regarding maintainability of this writ petition on the ground that the petitioner has a statutory remedy of appeal against the order impugned in this writ petition under the U.P. Government Servants (Discipline and Appeal) Rules, 1999 (hereinafter referred to as 'the Rules, 1999').
4. On being confronted, learned counsel appearing for the petitioner could not deny the availability of statutory remedy in the form of appeal under the Rules, 1999.
5. In view of the aforesaid reason, this writ petition is dismissed on the ground of statutory remedy available to the petitioner in the form of appeal under the Rules, 1999.
