Heard learned counsel for the revisionist and learned AGA for the State of U.P. as well as perused the record. 2. By means of instant revision, the revisionist has challenged/impeached the order dated 23.04.2024 passed by the Ist Additional Principal Judge, Family Court, Hardoi (in short "Family Court") in Criminal Misc. Case No. 362 of 2018 (Smt. Shyam Bati @ Rita vs. Shyam Prakash @ Shyam Kishore), instituted on 05.07.2018 in terms of Section 125 Cr.P.C., and also the order dated 30.08.2025 passed by the Family Court in Case No. 629/2025 (Shyam Prakash @ Shyam Kishore vs. Smt. Shyam Bati @ Rita), instituted by the revisionist in terms of Section 126 Cr.P.C. 3. It is to be noted that vide order dated 23.04.2024, the Family Court awarded Rs. 2500/- per month to the opposite party No. 2/Smt. Shyam Bati @ Rita and Rs. 1500/- per month to the opposite party No. 3/Pranshi (daughter of revisionist) towards maintenance from the date of preferring the application under Section 125 Cr.P.C. i.e. 05.07.2018 to the date of final order i.e. 23.04.2024. The operative portion of the order dated 23.04.2024 reads as under:- "याची श्यामवती उफर् रीता की ओर से प्रस्तुत यािचका अन्तगर्त धारा-125 दण्ड प्रिक्रया संिहता एकपक्षीय रूप से स्वीकार की जाती है। िवपक्षी श्याम प्रकाश उफर् श्याम िकशोर को आदेिशत िकया जाता है िक वह याची संख्या-01 श्यामवती उफर् रीता को मु०-2,500/- रूपये प्रितमाह की दर से एवं याची संख्या-02 प्रांशी को मु०-1,500/- रूपये प्रितमाह की दर से कु ल मु०-4,000/- रूपये भरण-पोषण अदा करना सुिनिश्चत करे। उक्त भरण-पोषण की धनरािश यािचका प्रस्तुत करने के िदनांक 05-07-2018 से देय होगा। Versus Counsel for Revisionist(s) : Raghunath Prasad Counsel for Opposite Party(s) : G.A. And 2 Others .....Opposite Party(s) यािचका प्रस्तुत िकए जाने की ितिथ 05-07-2018 से लेकर िनणर्य की ितिथ तक देय भरण-पोषण की धनरािश को िवपक्षी तीन माह के अन्दर याचीगण को प्रदत्त करे एवं िनणर्य की ितिथ के पश्चात से देय भरण-पोषण की धनरािश को प्रत्येक माह की 10 तारीख तक िवपक्षी द्वारा याचीगण को प्रदत्त िकया जाए।" 4. It is also to be noted that vide order 30.08.2025 passed in Criminal Misc. Case No. 629/2025 (Shyam Prakash @ Shyam Kishore vs. Smt. Shyam Bati @ Rita), instituted by the revisionist in terms of Section 126 Cr.P.C., the Family Court allowed the said case upon payment of Rs. 1,48,000/- as maintenance to the opposite party No. 2 and 3, wife and daughter, respectively, of the revisionist. The operative portion of the order dated 30.08.2025 reads as under:- "प्राथर्ना-पत्र 03 अ, अन्तगर्त 126 दण्ड प्रिक्रया संिहता मु०-1,48,000/-रूपये भरण-पोषण की धनरािश अपनी पत्नी श्यामवती उफर् रीता व पुत्री प्रांशी को अदा करने के उपरान्त स्वीकृ त िकया जाता है। पत्रावली िदनांक 17-09- 2025 को उपयुर्क्त धनरािश की अदायगी हेतु पेश हो। यिद िनयत ितिथ तक उपयुर्क्त धनरािश की अदायगी नहीं की जाती है तो उक्त आदेश स्वत िनरुस्त समझा जाएगा।" 5. Taking note of the aforesaid meagre amount awarded by the Family Court to the opposite party Nos. 2 and 3 vide order under challenge dated 23.04.2024 and also the findings recorded by the Family Court, as per which under compelling circumstances on account of ill-treatment by the revisionist the opposite party No. 2 alongwith minor was compelled to live separately and also various pronouncements on the subject including passed in the case(s) of Anju Garg and another vs. Deepak Kumar Garg, 2022 SCC OnLine SC 1314; Sanjeev Kapoor vs. Chandana Kapoor and others, (2020) 13 SCC 172; Chander Parkash Bodh Raj vs. Shila Rani Chander Prakash, 1968 SCC Online Del 52; Rajnesh vs. Neha, (2021) 2 SCC 324 : (2021) 2 SCC (Civ) 220 : 2020 SCC OnLine SC 903 at page 347; Kulbhushan Kumar Vs. Raj Kumari, (1970) 3 SCC 129; Kalyan Dey Chaudhary Vs. Rita Dey Chaudhary Nee Nandy, (2017) 14 SCC 200 and also that till date financial assistance since 05.07.2018 (date of institution of case under Section 125 Cr.P.C.) has not been provided by the revisionist to the opposite party Nos. 2 and 3, this Court finds that the instant revision is liable to be dismissed, as the same has been filed just to avoid the payment of meagre amount awarded by the Family Court.
