This petition has been filed by the petitioner with the following prayer: "(i) Issue a order or direction to direct the opposite party no. 1 Additional Civil Judge (SD) Court No. 44, Lucknow to decide the matter case bearing Original Suit no. 330 of 2018 (Case No. 13 of 2020) (M/S S.M. Tech Nigeria Vs. Sushmita Kumari & Others) which is pending since 2018 before him as expeditiously as possible." 3. It is argued by the counsel for the petitioner that even the written statement has not been filed by the defendants. 4. In view of the said submission, the petition is disposed of permitting the petitioner to file an application under Order 8 Rule 10. In case such an application is filed, the same shall be decided in accordance with law with all expedition without giving any unnecessary adjournment to either of the party.
