The application for condonation of delay of 86 days in filing the appeal by the State against the judgment dated 22.03.2024, passed in CWP No.3468 of 2023, titled as Loktantra Senani Sangh Himachal Pradesh Versus State of HP & Anr. has been filed.

The averments contained in the application are that on 06.04.2024 after receipt of an intimation from the office of Advocate General, the matter was examined and it was opined to assail the judgment and the delay as such has taken place which is bonafide and not intentional.

The application has been opposed by filing reply. In the reply it is stated that it has not been disclosed by the applicants that when certified copy has been applied that how the delay has occurred.

Keeping in view the nominal delay as such and the fact that the State is placed at a higher pedestal and since there is no inordinate delay, we are inclined to condone the same.

Therefore, we are of the considered opinion that each and every day’s delay is not required to be explained, in view of the law laid down in Collector, Land Acquisition, Anantnag and Another Versus Mst. Katiji and Others, (1987) 2 SCC 107.

Accordingly, for the reasons given in the application, which is supported by an affidavit, the application is allowed and delay of 86 days in filing the appeal is condoned. Application stands disposed of. Appeal be registered. LPA [Filing] No.26020 of 2024
