Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents herein in dismissing the petitioner from service as Asst. Sub-Inspector of Police 43/2021/R.O.R.NO.875/2023, dated 9- 9-2023 by the 4th respondent and in appeal, vide C.NO.C2/OEPR- vide impugned
consequential rejection orders passed D.Dis.No.111/T2/2024, dated 19-2-2024 by the respondent are highly illegal, arbitrary , contrary to the law and also Rule 20 CCA Rules and also unconstitutional and consequentially the Honble Court may pleased to set aside the dismissal orders dated 9-9-2023 and consequential orders in appeal dated 19-2-2024 by declaring that the petitioner is entitled for reinstatement into service as ASI with all consequential benefits including seniority etc. and may pass such other order. THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.11289 of 2024 ORDER:
1. The present Writ Petition is filed questioning the action of Respondents in dismissing the Petitioner from service as Assistant Sub-Inspector of Police vide No.43/2021/ROR No.875/2023 dated 09.09.2023 by Respondent No.4 and in Appeal vide C.No.C2/OEPR vide impugned consequential rejection orders passed D.Dis.No111/T2/2024 dated 19.02.2024 by the Respondents, as illegal and arbitrary. 2. At the time of hearing, learned Assistant Government Pleader passed on the instructions dated 21.03.2025 of Respondent No.1, wherein it was stated that the Revision filed by the Petitioner against the impugned order is allowed modifying the penalty of “Dismissal from Service” and Petitioner was reinstated into service with immediate effect. 3. In that view, no cause survives for adjudication in this case and the Writ Petition is accordingly closed granting liberty to the Writ Petitioner to challenge the order passed by the Revision authority in an independently constituted Writ Petition. 4
