Now, it is admitted position that the appellate forum is available and is functioning i.e. the Real Estate Appellate Tribunal, Lucknow, therefore, we see no reason to proceed further in the matter. The interim order, which was granted on 30.10.2023, has not been extended since then. None appears for the private opposite parties though learned counsel for the RERA is present. In the interest of justice, only for a period of fifteen days it is provided that no demand shall be raised against the petitioner under the order impugned herein. This order is being passed only to facilitate filing of the appeal aforesaid. If the appeal is filed within ten days, it shall be placed before the Bench concerned within the next five days.
