The present Writ Petition is filed questioning the inaction of the Respondents in not making payment of Rs.24,90,202/- for the works executed by the Petitioner i.e., i) Agreement No.411/Jto-1/2023-2024 Dt.12-01-2024m for Laying of ‘CC Roads From Subramanyam House to Mallikarja House at Pedha Cherukur in Division No. 2 in Nellore Municipal Corporation Under GGMP Grant’ vide M Book No.2050/23-24 for Rs.6,97,652/-; ii) Agreement No. 410/Jto-1/2023-24, Dt.12.01.2024 for Laying of ‘CC Road at Y Padm a House to Sk. Masthan House Peddacherukuru in Division No 2 of NMC under GGMP Grant; vide M Book No.2047/23-24 for Rs. 4,47,953/-; iii) Agreement No. 409/Jto-1/2023-24, Dt. 12.01.2024 for Construction of ‘CC Drain from ST Colony 1 Cross Road to ST Colony 2 Cross Road Allipuram in 12th Division (12/1) of NMC Under GGMP Grant’ vide M Book No.1874/23-24 for Rs.4,84,522/-; iv) Agreement No 407/Jto-1/2023-24, Dt 12-01-2024 for Construction of ‘CC Drain and culvert from Padma House to SK. Masthan House Peddacherukuru in Division No 2 of NMC Under GGMP Grant’ vide M Book No. 1877/23-24 for Rs 89 847/- and v) Agreement No 408/Jto-1/2023-24, Dt.12-01-2024 for Laying of ‘CC Road Allipuram Harijana Wada to Main Road in Division No 2 of NMC Under GGMP Grant’ vide M Book No. 2018/23-24 for Rs 7,70, 228/-”. 2. Learned counsel for the Respondent Nos. 6 and 7 filed their joint Counter Affidavit wherein the agreement and execution of work were 3 admitted. It is also stated that after completion of the work, Respondent No.6 has prepared and submitted the bills for Rs.28,34,495/- (Gross) (Rs.25,57,757/- ( Net)) for release of payments. It is also stated that due to non availability of the funds under GGMP account, the amounts could not be paid to the Petitioner. 3. Since the execution of work and the amount due to the Petitioner are not in dispute, this Court deems it appropriate to dispose of the Writ Petition with the following direction: i) The Respondent Authorities are directed to make the payment of the amount due to the Petitioner within a period of Four months from today. ii) There shall be no order as to costs. 4. The Writ Petition is disposed of accordingly.
