HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW APPLICATION U/S 482 No. - 8060 of 2025 Court No. - 14 HON'BLE SHREE PRAKASH SINGH, J. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. The instant application has been filed with the prayer to quash the order dated 11.7.2025 passed by the Chief Judicial Magistrate, Lucknow in F.I.R. No.486/2024 registered under Sections 352, 316(2) of BNS (corresponding Sections 504, 406 I.P.C.) and further direction to Chief Judicial Magistrate for monitoring the case as well as direction to the police authorities to recover the stolen motorcycle involved in F.I.R. No.486/2024 which is case property and is being used and it is being challaned on different dates to secure any mishappening or involvement of any crime in future. The aforesaid prayer is in two fold- one is for quashing of the order dated 11.7.2025 passed by the Chief Judicial Magistrate Lucknow in F.I.R. No.486 of 2024 and the second one is regarding direction to the Chief Judicial Magistrate for monitoring the case as well as the direction to the police authorities to recover stolen motor cycle involved in the F.I.R. There seems to be no merit in the ground taken by the learned counsel for the applicant during the course of his arguments regarding his first part of the prayer. So far as the second prayer is concerned, the same is frivolous as no such order can be passed while invoking the inherent power directing the Chief Judicial Magistrate for monitoring the case.
