Deb, learned Legal Aid Counsel who has submitted that the applicant intends to approach this Court by way of an appeal, being aggrieved by judgement and sentence directed against him, the same being dated 25. 07. 2023 and 31. 07. 2023 respectively, connected to special POCSO case No.16 of 2017 and passed by the Special Judge POCSO, Ri- Bhoi District, Nongpoh. However, while preferring the appeal, a delay of 786 days has occurred, the fact being that the applicant is not financially sound and is also uneducated and therefore is not aware of the process for filing of an appeal. It was only when the Legal Aid was accorded to him that the appeal was able to be filed. It is prayed that the delay may be condoned and the appeal be admitted. Mr. H. Kharmih, learned Addl. PP has no objection to the prayer made, we have considered the submission made and have also noted that the period for delay as stated in the application is 786 days whereas the office note would show that the actual delay is 728 days. It would not be so material to refer to this discrepancy, suffice it to say that we are convinced that the delay has been sufficiently explained. 2025:MLHC:959-DB Accordingly, the delay in filing the related appeal is condoned and the petition is hereby allowed and disposed of.
