ELEVATED AS JUDGE The Court made the following: ORDER: The Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief: “…to issue an appropriate Writ, Order or direction more particularly a Writ in the nature of Mandamus declaring the action of the 2nd 3rd respondents in not acted upon the Email representation dated 22.07.2016 for irregularities as admitted by the 5th respondent in its Office as reported in the News Paper District Local Edition Dated 16.07.2016 is illegal, Aribitrary Contrary to the provisions of the A.P Charitable and Hindu Religious Institutions and Endowments Act, 1987 and consequently direct the respondents to take necessary action on irregularities committed in the Office of the 5th respondent and pass…….” 2. Heard Mr G.Simhadri, learned counsel for the petitioner and the learned Government Pleader for Endowments appearing for the respondents. 3. On hearing, learned counsel for the petitioner submits that though the petitioner has submitted representation, dated 22.07.2016 to Respondent Nos.2 and 3 requesting to take action on irregularities committed in the office of the 5th respondent temple, but Respondent Nos.2 and 3 have not acted on the said representation which is illegal and arbitrary. Hence, the learned counsel for the petitioner requests to pass appropriate orders. 4. Per contra, learned Government Pleader for Endowments submits that the departmental domestic enquiry is going on and the same will be completed after following the due procedure. Thereafter, department will take action against erred officers if they are found guilty of any irregularities or misdeeds. He further submits that as the Respondent Nos.2 and 3 are taking action on the representation of the petitioner, dated 22.07.2016, no cause survives in the present Writ Petition and it may be closed. 5. Recording the said submissions, the Writ Petition is closed. There shall be no order as to costs.
