Hon'ble Rohit Ranjan Agarwal,J. This is defendant's petition. The suit filed by plaintiff was decreed against which an appeal has been preferred by petitioner which is pending consideration. This writ petition has been filed seeking a direction upon some of the respondents not to carry out the work under Mahatma Gandhi National Rural Employment Guarantee Scheme. As the appeal itself is pending and has been preferred by petitioner himself, he has remedy of moving an application before appellate court for grant of relief as claimed in the present writ petition. Writ petition is not maintainable under Article 227 of Constitution of India and petitioner has already availed the remedy and his appeal is pending consideration before appellate court.
