Heard learned Counsel for the petitioner and learned Standing Counsel appearing on behalf of the State Respondents. 2. This petition has been filed with the following main prayer:- "Issue a writ in the nature of Mandamus directing the opposite parties to take action against the encroacher of Surplus land/ Bachat Land of gata no.293 area 0.049 hec to remove the encroachment made by opposite party no.6 through planting the paddy crops and save the surplus land declared by consolidation authorities in gata no.293 area 0.049 hec situated at Village- Daulatpur Lonhat, Tehsil- Musafirkhana, District- Amethi" 3. We have gone through the pleadings on record and also the representation made by the petitioner on I.G.R.S. where a report had been submitted on 27.05.2025, wherein proposed chak on Gata No.293 is clearly indicated. However, the respondent no.6 has encroached upon such surplus land and no action has been taken against him even though a report in this regard has been submitted. 4. This petition is disposed of with a direction to the petitioner to move an application before the Consolidation Officer, Musafirkhana, Amethi, within a week from today.
