Mr. Aditya Singh, learned counsel for the revisionists. 2. Mr. J.C. Belwal, learned counsel for the respondents. 3. The instant Civil Revision has been preferred by the revisionists against the judgment and decree dated 22.12.2021 passed by Judge, Small Cause Court / 3rd Addl. District Judge, Udham Singh Nagar, in SCC Case No. 04 of 2016 (Chandra Pal Vs. Saddan) whereby suit filed for eviction and payment of arrears of rent has been decreed. 4. Learned counsel for the revisionist, on instructions, submits that revisionist is ready to vacate the property, in question, on or before 30.06.2027 and pay enhanced rent @ Rs. 1500/- per month. 5. Mr. J.C. Belwal, learned counsel for the respondents has no objection on such proposal, however, he submits that revisionist shall pay enhanced monthly rent @ Rs. 1500 per month regularly without any interruption and without causing any damage to the property. 6. In such view of the matter, since the revisionist is ready vacate the shop in question on or before, 30.06.2027 and to pay enhanced rent @ Rs. 1500/- per month, present civil revision is disposed of with the direction to revisionist to vacate the property, in question, on or before, 30.06.2027 and to pay regularly rent @ Rs. 1500 per month with effect from 01.12.2025 and without causing any damage to the property in question. It is also made clear that amount, if any, deposited in the SCC Court will be adjusted in payment of decreetal amount. Revisionist shall also file an undertaking to this effect before the Trial Court / Executing Court within two weeks from the date of receipt of the order and if the revisionist fails to comply with the undertaking given before this Court, the executing court shall take immediate step to vacate.
