For the State : Mr. Satish Kumar Keshri, A.P.P. …..... 5/11.07.2025: This anticipatory bail application under Section(s) 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for the offences registered under Section(s) 414, 272, 273, 290 IPC and Section 47(a) of the Excise Act, in connection with Ichak P.S. Case No. 45/2020, pending in the court of learned Judicial Magistrate, 1st Class, Hazaribag. 2. Heard the parties at length and had gone through the documents, annexed along with this application. 3. Opportunity was given to the State to oppose the bail, which the State availed and opposed. 4. Counsel for the petitioner submits that the there is no involvement of the petitioner in this case, even the vehicle which was transporting the illicit liquor does not belong to the petitioner. 5. Learned A.P.P submits that the apprehended accused persons had disclosed the name of the petitioner that he was also involved in transporting of alcohol to the State of Bihar. He further submits that the petitioner has got similar nature of case registered against him being Ratu P.S. Case No. 189 of 2021 registered for the offence under Section 268, 290, 467, 468, 469, 471 and 420 IPC and 47(a) of the Excise Act, which is pending. 6. After hearing the parties, I find that huge consignment of liquor was being transported to the State of Bihar illegally. The petitioner is named in the FIR as his name has transpired from the apprehended persons and he was shown to be the owner of the vehicle, though the petitioner is not the registered owner, but the allegation is that he was involved in transporting the illicit liquor. Further from the case diary, I find that the petitioner has criminal antecedent. 7. In view of the aforesaid facts, I direct the petitioner to appear before the court concerned and pray for regular bail, which will be considered by the court concerned without being prejudiced by the order of this Court as well as considering the specific overt act of this petitioner. 8.
