Hasan, learned counsel for the petitioner. Also heard Mr. Swajeet Ubeja, learned Panel Lawyer, appearing for respondent No. 2/State. 2. The present petition has been filed by the petitioner with the following prayer: “That in the interest of justice the charge-sheet is false & fabricated and is liable to quashed. Otherwise the BRIJMOHAN MORLE Digitally signed by BRIJMOHAN MORLE Date: 2025.04.30 18:22:01 +0530 2 innocent person’s applicant/accused may suffer and irreparable loss.” 3. From perusal of the prayer and pleadings made in the present petition, it transpires that admittedly, charge-sheet has been submitted against the petitioner before the competent Court, but, in the opinion of this Court, the prayer is defective one as there is no mention of the offences under which charge-sheet has been submitted before the trial Court and offences under which the FIR has been lodged against the petitioner, to which learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with a liberty to file afresh petition with proper prayer. 4. Learned State counsel has no objection. 5. In view of the submission made by the learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for subject to depositing a sum of Rs. 2,000/- as cost by the petitioner before the Registry of this Court and submit a receipt of the same at the time of filing of the fresh petition, if any, and the amount so deposited, if any, shall be transmitted to the Government School for Visually and Hearing Impaired, Raipur (C.G.). 6. Certified copy of the FIR, charge-sheet along with the entire order- sheet may be returned back to the petitioner after retaining a photocopy of the same.
