Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. The instant application under section 483 Cr.P.C. has been filed with the prayer to direct the Principal Judge Family Court Ambedkar Nagar to decide the restoration case no. 57 of 2024 dated 11.03.2024/13.03.2024 (Shah Alam Vs. Kohenoor) u/s 126(2) Cr.P.C. against Ex-parte Judgement dated 30.08.2023 passed in Case No. 260/2022 (Kohenoor Bano Vs. Alam) u/s 125 Cr.P.C. against applicant P.S. Jalalpur, District Ambedkar Nagar within some specific time bound period or pass such other and further order which this Hon'ble may deem fit and proper. Learned counsel appearing for the applicant submits that the matter pertains to the year 2024 and even after passing of about 1 year, the proceeding of the case has not been concluded as yet. After arguing at some length, learned counsel appearing for the applicant submits that interest of justice would be sub-served if this Hon'ble Court may be pleased to direct the trial court to decide the matter within the stipulated period of time as may be fixed by this court. Considering aforesaid innocuous prayer, the trial court concerned is directed to consider and decide the case no. 57 of 2024, if the matter is still pending consideration, with expedition, in accordance with law considering the instructions and guidelines issued by this court; time to time.
