(2) There is delay of 107 days in filing the review application. Mr. Dinesh Gahatori, learned Counsel for the ONGC, does not oppose the prayer for delay condonation. Accordingly, delay condonation application (IA/ 2/ 2025) is allowed. Delay is condoned. (3) This writ petition was dismissed vide judgment dated 15.7.2025. Today, the matter is listed on review application (MCC/ 1/ 2025), filed by Counsels different from the Counsel, who appeared and argued the matter on behalf of petitioner at the time of decision of the writ petition. (4) Learned Counsel for the review applicant submits that petitioner’s husband was member of Composite Social Security Scheme, therefore petitioner is entitled to compensation amounting to rupees fifty lakhs. (5) Perusal of the record reveals that petitioner’s husband applied for pre-mature retirement, a few days before he was to attain age of superannuation. As observed in para 7 of the judgment sought to be reviewed, the provision for pre-mature retirement is akin to the power available to employer to compulsorily retire an employee before his/ her completion of age of superannuation. (6) Learned Counsel for the review applicant sought to reargue the case on merit, which is not permissible. There is no error apparent on the face of record which may justify invocation of review jurisdiction. Accordingly, review application is dismissed. ( Su bh ash Upadh y ay , J.)
