Rakesh Kainthla, Judge The petitioner has filed the present petition for quashing of F.I.R. No. 160 of 2024, dated 19.10.2024, registered at Police Station Nahan, District Sirmour, H.P. for the commission 2( 2025:HHC:23797 ) of offences punishable under Sections 125(a), 125 (b) and 281 of the Bhartiya Nyaya Sanhita,2023 (BNS) and criminal proceedings arising out of the said FIR pending before the learned Judicial Magistrate First Class, Nahan, District Sirmour (learned Trial Court) as per the compromise effected between the parties. It has been asserted that the parties entered into a compromise with the intervention of respectable persons of the locality. The informant does not want to pursue the matter because of the compromise. Hence the present petition. 2. The statements of the informant Amjad Ali and injured Shivam Sharma, and Ojasvi Singh were recorded on 19.06.2025, in which they stated that they had entered into a compromise with the accused voluntarily without any influence from any person. 3. Heard. 4. The offence punishable under Section 281 of the B.N.S corresponds to Section 279 of the Indian Penal Code (I.P.C), Section 125 (a) corresponds to Section 337 of the IPC, and Section 125(b) of B.N.S. corresponds to Section 338 of the IPC. This Court 3( 2025:HHC:23797 ) has already quashed the F.I.R. registered for the commission of offences punishable under Sections 279 and 337 of IPC in Sushant vs State of H.P. 2023 HLC 531, Vikas Huda vs. State of H.P. 2023 STPL 3009, Kulwidner Singh vs Ankush Kumar 2023 HLR 384 and Nishant vs. State 2022 Suppl. Law Cases based on compromise. These judgments are binding on this Court. 5. Therefore, in view of these precedents, the present petition is allowed and the F.I.R. No. 160 of 2024, dated 19.10.2024, registered at Police Station Nahan, District Sirmour, H.P., for the commission of offences punishable under Sections 125(a), 125 (b) and 281 of the BNS and consequent proceedings arising out of the said F.I.R. are quashed. 6. Petition stands disposed of in the above terms, so also pending applications, if any. 7.
