--- CORAM:
HON’BLE MR. JUSTICE RONGON MUKHOPADHYAY
---
For the Petitioner : Mr. Vipul Poddar, Advocate For the State
: Mr. Mohan Dubey, AC to AG
--- 24/12.06.2025 Heard Mr. Vipul Poddar, the learned counsel for the petitioner and Mr. Mohan Dubey, the learned AC to AG.
In this application, the petitioner has prayed for initiation of contempt proceeding against the opposite parties for willful and deliberate violation of the order dated 27.03.2023 by passed by this Court in WP(C) No. 247 of 2023.
The operative portion of the order dated 27.03.2023 passed in WP(C) No. 247 of 2023 reads as follows:
“In such view of the matter, therefore, the petitioner is directed to submit a fresh representation before the respondent no. 2 mentioning about his grievance along with the supporting documents within a period of two weeks and if such representation is filed the respondent no. 2 shall dispose it of by a speaking and reasoned order within a period of four weeks from the date of receipt of the representation.
If the claim of the petitioner is found to be in the affirmative the respondent no. 2 shall take steps for releasing the admissible amount in favour of the petitioner within a period of four weeks from the date of disposal of the representation.”
A supplementary show-cause has been filed on behalf of the opposite party no.2 from which it appears that the reasoned order has been passed on 20.02.2025.
The same therefore is in compliance of the order dated 27.03.2023 passed in WP(C) No. 247 of 2023.
In such circumstances, I do not intend to proceed further and this contempt application accordingly stands disposed of with the liberty to the petitioner to challenge the reasoned order dated 20.02.2025 in an
appropriate proceeding.
Pending IA, if any, stands disposed of.
