Joshi, learned Additional Advocate General for the State of Uttarakhand. 3. By means of this Writ Petition, which was filed in 2013, petitioner has sought the following reliefs:- “(i) Issue writ rule or direction in the nature of certiorari quashing the impugned judgment and order dated 18.07.2013 passed in Execution Application No. 01/2012, Daya Ram Vs. Chief Revenue Commissioner & others by the learned State Public Service Tribunal of Uttarakhand in leaque with order dated 14.01.2013 passed by the respondent no. 3 after calling the entire records from the respondents along with its effect and operation also. (ii) Issue writ rule or direction in the nature of mandamus to directing to the respondents to include the name of the petitioner at the appropriate place in the seniority of state cadre of revenue inspector along with all consequential benefits and consider his case for promotion on the post of Nayab Tehsildar.” 4. Today, when the matter is called out, Mr. M.C. Pant, Advocate, submits that, although the petitioner has subsequently been promoted, however, the promotion 2025:UHC:3284-DB given to him is not from the due date, therefore, he submits that petitioner be permitted to withdraw this Writ Petition, with liberty to file a fresh Writ Petition. 5. State counsel has no objection to the prayed made by Mr. M.C. Pant, Advocate. 6. Accordingly, the present Writ Petition (S/B) No. 280 of 2013 is dismissed as withdrawn, with liberty as prayed for.
