Heard the learned counsel for the petitioner and the learned Standing Counsel who appears on behalf of the State-respondent nos.1, 2 and 3. 2. This petition has been filed by the petitioner for the following prayers:- "i. To issue a writ, order or direction in the nature of Mandamus, thereby commanding the OP. No. 3 to take Application dated 19.08.2025 on record and grant permission to the Petitioner for the Visarjan procession and immersion of the Goddess Durga idol on the day of Dusshera at nearby Ghat in Village Nandauri. ii. To direct the Respondents to provide adequate police protection to ensure the peaceful and secure conduct of the procession and immersion ceremony. iii. To issue any other suitable writ, order or direction in which this Hon'ble Court deems just, fit and proper in the facts and circumstances of the case, in favour of the Petitioner. iv. Award the cost of the writ petition in favour of the petitioner." 3. It is the case of the petitioner that he wishes to install Idol of Versus Counsel for Petitioner(s) : Rajneesh Yadav, Anchal Shukla Counsel for Respondent(s) : C.S.C. Shiv Pujan .....Petitioner(s) State Of U.P. Thru. Addl. Chief Secy. Home Lko. And 2 Others .....Respondent(s) Goddess Maa Durga at Kali Sthan located in Village Mainaha (Bhaisahi) Terhwa, Navabad, Utraula, District Balrampur as has been organized for the past ten years alongwith Murti Visarjan / Immersion of Idol of Goddess Durga at any place located in Village Kali Sthan. However, an application was made to the S.D.M., Utraula, District Balrampur, by the petitioner on 19.08.2025 but the same has not been decided as yet. 4. This writ petition is disposed of with a direction to the Sub- Divisional Magistrate, Tehsil Utraula, District Balrampur to look into the application of the petitioner and pass an appropriate order therein within a period of three days' from today. 5. Learned Standing Counsel shall inform the S.D.M., Tehsil Utraula, District Balrampur, about the order passed today without waiting for the uploading of the order on the High Court Website.
