Heard learned counsel for the parties. 2. This Public Interest Litigation has been filed seeking the following relief. "(i). issue a writ, order or command in the nature of Mandamus, thereby directing the opposite parties no. 1 to 4 to change the land use and develop a public park over Nai Parti situated over land gata no. 934 measuring 0.0840 hectare of village Bharwara, Tehsil Lucknow. (ii). issue any other writ, order or command which this Hon'ble Court deems fit and proper in the circumstances of the case." 3. It is alleged that the land bearing Gata No. 934 situated in village Bharwara, Tehsil Lucknow, which is recorded in the Khatauni as Naveen Parti has subsequently come within the purview of the Nagar Nigam and is being encroached, therefore, a Park be developed. This is not a matter to be considered under Article 226 of the Constitution. It is for the concerned authority whether it be the Nagar Nigam or any other authority to consider as to whether park should be developed thereon or not. Petitioner may make his suggestions to the concerned officer in this regard, who can consider such suggestions.
