(2) According to petitioners, a road and a school were constructed over their agricultural field without paying any compensation. Relief sought in the writ petition is as follows: “i. Issue a writ order or direction in the nature of mandamus directing the respondents to pay the whole compensation (quid pro-quo) along with interest to the petitioners of their land Khet no. 1042 A area 0.316 hectare and Khatauni no. Is 257, Village- Maholiya, Pargana- Billari, Tehsil- Khatim, District- U.S. Nagar.” (3) Learned Counsel for the petitioners submits that in identical facts in WPMS No. 3442 of 2023, this Court directed the District Magistrate to take decision on the representation made by the petitioner. (4) Learned State Counsel submits that he has no objection if petitioner is permitted to make representation to District Magistrate. (5) Accordingly, writ petition is disposed of with liberty to petitioners to make representation to District Magistrate concerned highlighting their grievance. If they make representation within three weeks from today, decision thereupon shall be taken, as per law, within four months thereafter.
