Respondent/Respondent /Complainant PRAYER: Criminal Revision Petition is filed under Section 438 r/w 442 of BNSS, to call for the records of the judgment dated 30.08.2024 passed in Crl.A.No.2 of 2024 on the file of the learned Additional District Judge (FTC), Theni, confirmed the judgment passed in S.T.C.No.63 of 2021 dated 18.10.2023 on the file of the learned Judicial Magistrate (FTC), Theni, and to set aside the same. For Petitioner : Mr.S.Muniyandi For Respondent : Mr.N.Jeyaram Sidharth ORDER This Court, by an order dated, 09.01.2025, while suspending the sentence, directed the petitioner to deposit 20% of the compensation amount before the learned Judicial Magistrate (FTC), Theni. Subsequently, the petitioner has moved an application seeking 1/4 https://www.mhc.tn.gov.in/judis CRL RC(MD)No.1401 of 2024 extension of time and in the extension petition, this Court granted time till 06.03.2025. 2. When the matter was taken up on 07.03.2025, the learned counsel for the petitioner submitted that since the petitioner was hospitalized, she could not pay the amount and requested time till 17.03.2025. Even thereafter, when the matter was taken up for hearing on 19.03.2025, the learned counsel for the petitioner sought time. Hence, the suspension of sentence already granted was cancelled, by an order, dated 19.03.2025, and directed to secure the accused and proceed further in accordance with law. 3. Thereafter, this case came before me on 03.06.2025, on which date, there was no representation for the petitioner and the matter was directed to be listed on 04.06.2025. Even on 04.06.2025, there was no representation for the petitioner and the matter was directed to be listed on 23.07.2025 under the caption for dismissal. 4. On 23.07.2025, when the matter was taken up for hearing, the learned counsel appeared before this Court and submitted that the 2/4 https://www.mhc.tn.gov.in/judis CRL RC(MD)No.1401 of 2024 appeal cannot be dismissed for default of payment of 20% of the compensation, for which, this Court categorically directed the petitioner to comply with the order passed by this Court on 09.01.2025. 5. Even today, the same was not complied with. Hence, this Criminal Revision case is dismissed.
