Order: This Criminal Petition under Sections 480 and 483 of B.N.S.S., has been filed by the petitioner/Accused, seeking regular bail in Cr.No.324/2024 of IV Town Police Station, Visakhapatnam District. 2. The above said crime was registered against the petitioner/Accus ed herein for the offence punishable u/Secs. 318(4), 69 of BNS. 3. In brief, it is the case of prosecution that on 20.12.2024, the complainant/victim Koralana Anitha turned up to police station and lodged a written report duly stated that, she is the home maker and her husband working in Visakha Container Terminal. On 28.04.2024 she along with her husband and daughter went to beach on the occasion of their marriage day, while she sat separately due to some disputes with' her husband. On that one Sankar who is their relative came along with another person and wished her. Later, the other person introduced himself as a Pastor i.e. accused who observed her distress and told her, that there were some evil spirits in her soul and her house. He further
gave an advice (hat, if she believes in Jesus, ail her problems would be vanished. Later, he got acquaintance with her their home to pray and offered her that if he would and occasionally visited she believes in Jesus Christ. arrange any job to her. Later, he participated in sexual intercourse to release her difficulties/stress. SO that she would be blessed with god’s grace. Later, he forcefully had her in the absence of her family sexual intercourse with members. Later, he took her to Jalaripeta and kept her in a house with a promise that he would marry cash of Rs. 10,000/- and took her if necessary and took her gold ring and a rented house at P.M.Palem where he had sexual intercourse with her and later started harassing her. Heard and perused the record. 5. The learned counsel for the petitioner submits that the petitioner has been in judicial custody since 03.02.2025. A reading of the reveals that the de facto complainant/victim is a married woman, and the petitioner is known to her.
According to the petitioner made her believe that if she had him, all the problems in her body and household report contents of the report, the a physical relationship with would be resolved, and
she would live happily. The report further suggests that she is residing with her husband and children. The learned counsel for the petitioner further submits that the petitioner has been in judicial custody for more than 90 days. The learned Assistant Public Prosecutor submits that a primary charge sheet has been filed, completing most of the investigation. The learned Assistant Public Prosecutor, while opposing the prayer of the petitioner/accused, submits that the investigation is not yet complete. Upon inquiry, the learned Assistant Public Prosecutor confirmed that the petitioner has no criminal antecedents. 6. 7. This Court, without going into the submission made by the learned counsel for the petitioner regarding the applicability of Section 69 of the BNS (Section 376 of the IPC), finds that further detention of the petitioner is no longer required for conducting further investigation. Therefore, this Court is inclined to grant bail to the petitioner/accused, subject to the following conditions; (i) The petitioner/accused herein shall be released on his executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of the learned VI Additional District & Sessions Judge, Visakhapatnam;
(ii) On release, the petitioner/accused shall appear before the Station House Officer concerned on every Sunday between 10.00 a.m. and 1.00 pm for a period of three (03) months. (iii) The petitioner/accused shall not tamper with the evidence and hamper the investigation and shall cooperate for investigation. 8. Accordingly, the Criminal Petition is allowed.
