This anticipatory bail application under Section 482 of the Bharatiya Nyaya Suraksha Sanhita, 2023, has been preferred by the petitioner apprehending his arrest, for offences under Sections 112(2), 316(2), 318(2), 336(3), 338, 340(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. It is alleged that the petitioner and other named accused persons have cheated the victims in the name of online gaming and preparing forged GST bills along with reference. 4. Learned counsel representing the petitioner submits that the name of the petitioner only appeared from the confessional statement of co-accused who was apprehended and except the confessional statement, there is no other material against the petitioner. 5. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. However, he admits that the name of the petitioner transpired from the confessional statement of co- accused who stated that he along with the petitioner and others are involved in the offence. On query by the Court, learned A.P.P. submits that there is no material to suggest that there is any monetary transaction from the account of this petitioner. 6. Considering the fact that there is no monetary transaction from the account of this petitioner, I am inclined to allow this application. 7. Accordingly, this Anticipatory Bail Application stands 2025:JHHC:20845 2 allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st Class at Hazaribagh, in connection with Katkamdag P.S. Case No.33 of 2025, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property.
