KAMBHAMPATI RAMESH BABU The Court made the following Judgment: 2 THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI IA No.4 OF 2025 in/and Appeal Suit No:462 OF 2019 COMMON JUDGMENT: The Present Appeal Suit is filed by the Defendant Nos.3 and 4 challenging the Judgment and Decree dated 27.03.2019 in OS No.266 of 2014, on the file of the learned VII Additional District Judge, Gudur. During pendency of the Appeal, Defendant No.4 died and her legal heir was brought on record. 2. Heard Sri P.Ganga Rami Reddy, learned counsel for the appellant and Sri Kambhampati Ramesh Babu, learned counsel for the respondents. 3. Sri P.Ganga Rami Reddy, learned counsel for the appellant would submit that Defendant Nos.1 and 2, who are the vendors of Defendant Nos.3 to 5, and they remain ex-parte before the trial Court. 4. Appellants/D3 & legal heir of D4 as well as respondents/ plaintiff Nos.1 to 3 are in attendance and are identified by their respective counsel. The parties produced their respective Aadhar Cards and the same are taken on record. 3 5. The terms of the compromise memo were read-over to the respective parties and they admitted the same as true and correct. 6. On enquiry, both the parties would submit that at the intervention of the elders, they compromised the matter, as per the terms mentioned in compromise memo and requested to allow the Appeal, by setting Judgment and Decree dated 27.03.2019 in OS No.266 of 2014 and consequently, dismiss the Suit. 7. In the light of foregoing circumstances, compromise is recorded in terms of compromise memo, subject to payment of Stamp Duty and Registration required, if any, as per law. 8. In the light of terms of compromise memo, the Judgment and Decree dated 27.03.2019 in OS No.266 of 2014 on the file of the learned VII Additional District Judge, Gudur is hereby set aside. Consequently, the suit in OS No.266 of 2014 on the file of the learned VII Additional District Judge, Gudur is dismissed. 9. Accordingly, I.A.No.4 of 2025 is allowed and A.S.No.462 of 2019 is allowed in terms of compromise. There shall be no order as to costs. 4 10. Registry is directed to enclose a copy of compromise memo to the Decree. Interlocutory applications, if any, pending shall stand closed. ______________________________ JUSTICE B.V.L.N.
