HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 11088 of 2025 Court No. - 30 HON'BLE MANJIVE SHUKLA, J. 1. Heard Sri Rishi Raj, learned counsel for the petitioner and learned Standing Counsel for the State-respondents. 2. The captioned writ petition has been filed challenging therein the order dated 12.03.2025, whereby services of the petitioner had been placed under suspension. The petitioner through this writ petition has also challenged the order dated 21.08.2025, passed by the Director, Panchayati Raj, U.P., whereby after consideration of the inquiry report submitted by the Inquiry Officer, direction had been issued to conduct inquiry de novo. 3. Sri Rishi Raj, learned counsel appearing for the petitioner, after arguing at some length, has confined his prayer to the extent that a direction may be issued by this Court thereby commanding the disciplinary authority to conclude the disciplinary proceedings, pending against the petitioner, within a fixed time frame. 4. Learned Standing Counsel appearing for the State-respondents does not have any objection, if this Court provides a time frame for concluding the disciplinary proceedings pending against the petitioner. 5. I have considered the submissions made by the learned counsels appearing for the parties and I find that the prayer made by the learned counsel for the petitioner for a direction, for conclusion of the disciplinary proceedings within a fixed time frame, is innocuous in nature. Versus Counsel for Petitioner(s) : Rishi Raj, Avanish Yadav Counsel for Respondent(s) : C.S.C. Siddharth Shankar Pandey .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Panchayati Raj Deptt. Lko. And 3 Others .....Respondent(s) 6. Accordingly, this writ petition is disposed of with a direction to the disciplinary authority i.e. Director, Panchayati Raj, U.P., Lucknow to conclude the disciplinary proceedings pending against the petitioner within a period of four months from the date of presentation of certified copy of this order. 7. At this stage, Sri Rishi Raj, learned counsel for the petitioner has submitted that this Court may provide that if the disciplinary proceedings are not concluded within the time frame fixed by this Court, then the suspension of the petitioner shall stand revoked. 8. I have considered the submission made by the learned counsel for petitioner and I find that if the disciplinary proceedings are not concluded within a period of four months as provided by this Court, the petitioner may approach this Court again, and at that point of time this Court would consider, as to whether the suspension of the petitioner should be revoked or not. 9. Accordingly, I hereby provide that it would remain open for the petitioner to approach this Court for revocation of his suspension, if the disciplinary proceedings are not completed within a time frame fixed by this Court.
