For Petitioner : Mr.M.Divakaran For Respondents : Mr.P.Thambidurai Government Advocate
ORDER By relying on four sale deeds each dated 21.06.2004, the petitioner asserts title in respect of 7.54 ares in S.No.58/58. By further stating that the name of the petitioner has been erroneously mentioned in patta No.1716 as an extent of 7 ares instead of 7.54 ares, the petitioner made a representation to the Revenue Divisional Officer seeking rectification of the patta and the FMB sketch. The present writ petition has been filed in relation thereto. 2.Learned Government Advocate accepts notice on behalf of all the respondents. He submits that the matter is pending with the Revenue Divisional Officer and that orders would be passed on merits within 12 weeks from the date of receipt of a copy of this order after conducting an inquiry. 3.Apart from the title documents and patta, the petitioner has also placed on record the FMB sketch. The description in words provides that the extent is 7 ares. It appears prima facie that the dimensions do not add up to 7 ares. 2/4 https://www.mhc.tn.gov.in/judis
Therefore, a survey would be necessary as a prerequisite before determining the petitioner's claim. 4.Subject to the above observations, this writ petition is disposed of by directing the jurisdictional Revenue Divisional Officer to consider and dispose of the petitioner's request on merits within 12 weeks from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner and any other persons interested in the relevant property. No costs.
