Yadav, learned counsel for the petitioners, Sri D.S.Tiwari, for opposite parties no. 1 and 2 and Sri Prashant Kumar Singh, learned counsel for the opposite parties no. 3,4 and 5. With the consent of parties the writ petition is disposed of finally at the admission stage. By means of this petition the petitioners has prayed following relief : "i) Issue a writ, order and direction in the nature of mandamus to commanding the opposite parties to make the payment of post retiral dues and pension under 'Old Pension Scheme' and 1 Pay the pension and other post retiral dues in accordance to the Old Pension Scheme to the Petitioners within time stipulated by this Hon'ble Court, with all consequential benefit. ii) Issue a writ, order or direction in the nature of mandamus commanding the opposite parties to make the payment of post retiral dues and pension as per judgment passed by Hon'ble Supreme Court in the case of Prem Singh v. State of U.P. and Others reported in 2019 (10) SCC 516 as well as Writ - A No. 8968 of 2022 decided on 17.02.2023 within the time stipulated by this Hon'ble Court." Learned counsel for the petitioners has submitted that ends of justice would suffice if he is allowed to move a fresh representation before the opposite party no. 3 and the same may be directed to dispose it of with speaking and reasoned order within stipulated time. As such, without entering into the merits of the issue, the petitioners are permitted to move a fresh representation within 15 days before the opposite party no. 3 i.e. Vice Chancellor, Narendra Dev University of Agriculture & Technology, Kumarganj, District Ayodhaya taking all his pleas and grounds and enclosing his earlier representations along with all relevant documents. If such a representation is moved the opposite party concerned is directed to Versus Counsel for Petitioner(s) : Hanumant Lal Yadav Counsel for Respondent(s) : C.S.C., Prashant Kumar Singh Ram Dayal And 3 Others .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Agriculture Edu. And Research Council Lko. And 4 Others .....Respondent(s) dispose of the representation of the petitioners with speaking and reasoned order after affording an opportunity of hearing to the parties concerned, strictly in accordance with law expeditiously, say within a period of two months from the date of production of the certified copy of this order.
