(2) According to petitioners, they have share in a property, which was acquired for extension of Jolly Grant Airport at Dehradun, however the amount due to them as compensation has not been awarded and other co-sharers have pocketed entire amount of compensation. In this writ petition, petitioners have sought the following relief: “i) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents authorities to pay the amount of displacement allowance to the petitioners for the land acquired by the respondents authorities for the purpose of expansion of Jolly Grant Airport.” (3) Learned State Counsel rightly submits that determination of amount payable as compensation or the extent of share of petitioners in the joint property cannot be decided in a writ petition and these aspects can only be looked into by the authority under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. (4) Writ petition is, accordingly, disposed of with liberty to petitioners to approach appropriate authority under the aforesaid provision. Application, if made by the petitioner, shall be decided expeditiously.
