Heard learned counsel for the petitioner and learned Standing Counsel for the respondent State. 2. This petition has been filed by the petitioner with the following prayer :- "(ii). Issue a writ, order or direction in the nature of mandamus thereby commanding and directing the respondents to refund the amount of Rs.3,00,400/- with 12% interest to the petitioner from the date of payment of road tax i.e. 15.11.2023 till the date of actual refund deposited with the respondents as road tax on registration of his Hybrid-Electric Vehicle." 3. Learned Standing Counsel appearing on behalf of the respondent State submits that the Government has now taken decision on June 28, 2024 with regard to granting exemption from road tax to Hybrid electric vehicles, Strong hybrid electric vehicle, Plug-in hybrid electric vehicle, Series hybrid electric vehicle and Series parallel hybrid electric vehicle. 4. In light of the same, it is clear that amount paid by the petitioner for road tax was exempted. 5. Accordingly, respondent authorities are directed to refund the Versus Counsel for Petitioner(s) : Sanjay Singh Counsel for Respondent(s) : C.S.C. Vinod Kumar Rai .....Petitioner(s) State Of U.P. Thru. Its Prin./Addl. Chief Secy. Transport Deptt. Lko. And 2 Others .....Respondent(s) amount paid by the petitioner within a period of six weeks from date. 6. We make it clear that no interest shall be payable to the petitioner on the said amount. 7. With the above direction the writ petitions are disposed of.
