Heard the learned counsel for the petitioner and the learned Standing Counsel who appears on behalf of the State-respondent nos.1 to 5. 2. This petition has been filed by the petitioner for the following prayers:- "i. Issue a writ order or direction in the nature of Mandamus commanding the opposite parties to grant permission to the petitioner for installation of the idol of Goddess Durga in the premises of Ganvat Mata Mandir of the village, erection of Pandal, and immersion of the idol during the ensuing Durga Puja festival of September-October 2025. ii. Issue a writ, order or direction in the nature of Mandamus commanding the respondents to provide necessary police protection and administrative support during the installation, celebration, and immersion to ensure peace and order in the interest of justice. iii. Issue a writ, order or direction in the nature of certiorari quashing the impugned order No.934/JA-090-Bees-Durga Puja Installation- 2024 dated 30.09.2024 passed by the District Magistrate, Bahraich to Versus Counsel for Petitioner(s) : I.M. Pandey Ist, Ajeet Verma, Shivam Pandey Counsel for Respondent(s) : C.S.C. Navyuvak Durga Puja Samiti Thru. Authorized Representative Mr. Dharmraj .....Petitioner(s) State Of U.P. Thru. Secy. Home Deptt. U.P. Lko. And 4 Others .....Respondent(s) the writ petition to the extent it relates denial of permission to the petitioner Samiti for installation of the idol of Goddess Durga as contained in Annexure No.2 to the writ petition. iv. Issue such other writ, order or direction as deemed just and appropriate in the facts and circumstances of the case including an order as to costs in favour of petitioner in the interest of justice." 3. It is the case of the petitioner that the petitioner is the authorized representative of Navyuvak Durga Pooja Samiti, of Village Sarpanchpurwa, Dakhili Bagha, Police Station and Tehsil- Mihipurwa (Motipur), District Bahraich, U.P., and for the last many years during Navratri the Kalas Pooja and Goddess Durga's idol installed on the said place. Its immersion takes place after Navratri. The petitioner has made a Representation / Application to the Superintendent of Police and Station House Officer of P.S. Rupaidiha, District Bahraich, but no action has been taken. Thereafter, an application was made to the Sub-Divisional Magistrate, Nanpara, District Bahraich, by the petitioner on 04.08.2025 but no decision has been taken as yet. Hence, this petition has been filed with the aforesaid prayers. 4. This writ petition is disposed of with a direction to the Sub- Divisional Magistrate, Nanpara, District Bahraich, to look into the application of the petitioner and pass an appropriate order therein within a period of three days' from today. 5. Learned Standing Counsel shall inform the Sub-Divisional Magistrate, Nanpara, District Bahraich, of the order passed today without waiting for the uploading of the order on the High Court Website.
