This criminal jail appeal has been preferred by the appellant through Superintendent, District Jail Almora against the judgment and order dated 24.05.2019, passed by learned Special Judge (POCSO), Almora in Special Sessions Trial No.03 of 2019, State vs. Narendra Singh Bisht, whereby the appellant has been convicted under Section 8 of the POCSO Act and sentenced to undergo four years’ rigorous imprisonment with fine of Rs.5,000/- with default stipulation of two months’ additional simple imprisonment. Further the appellant has been convicted under Section 354 IPC and sentenced to undergo two years’ rigorous imprisonment with fine of Rs.5,000/- with default stipulation of two months’ additional simple imprisonment. Both the sentences were directed to run concurrently. 4. Learned Amicus Curiae had submitted on the last date that perhaps the appellant has already served out the sentence pursuant to the aforesaid judgment and order impugned in the present jail appeal. 5. Vide order dated 06.10.2025, learned State 2 Counsel was directed to bring on record the custody report of the appellant as to whether the sentence awarded to the appellant has been served out or not. 5. Today, learned State Counsel supplied instructions dated 07.10.2025 to the Court, which have been taken on record. On instructions, he submits that the appellant has already served out the sentence imposed upon him and he has been released from jail on 27.04.2022. 6. In such view of the matter, nothing survives in the present criminal jail appeal. Hence, the same is hereby closed. 7.
