HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 9264 of 2025 Court No. - 6 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the petitioner and learned Standing Counsel.
2. The present petition has been filed by the petitioner challenging the order dated 23.05.2025, whereby the interim application filed by the petitioner before the appellate authority came to be dismissed.
3. The facts in brief are that the licence of the petitioner, who is running a fair price shop, was sought to be cancelled, for which an inquiry was held and ultimately, an order was passed on 08.04.2025, whereby the fair price shop licence of the petitioner was cancelled. The petitioner preferred an appeal and along with the appeal, preferred an interim application, which has been dismissed by means of the impugned order.
4. The order of cancellation, which is on record, reveals that most of the card-holders had given statements in favour of the petitioner except 10 or 12 persons, who were belonging to the complainant's family as well as the political rival. As no major illegality was seen in view of the statements made, still an order came to be passed cancelling the licence of the petitioner.
5. Considering the fact that substantial evidence was not existing and the statements of the persons, who had given statements against the petitioner are complainant's family, the matter requires interference.
6. The present petition is disposed of with direction to decide the pending Versus Counsel for Petitioner(s) : Amit Kumar Singh, Deepak Verma Counsel for Respondent(s) : C.S.C. Shri Ram .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Food And Civil Supplies Lko. And 2 Others .....Respondent(s)
appeal within a period of three months from today.
7. Till the decision on the appeal, the order of cancellation shall remain stayed, meaning thereby that the petitioner would be permitted to run the fair price shop, subject to the decision on the appeal.
