Heard Sri Ram Sahay Yadav, the learned counsel for the applicant as well as Sri Satyendra Srivastava, the learned A.G.A. for the State and perused the record. 2. The instant application has been filed seeking release of the applicant on bail in Case Crime No.434 of 2025, under Sections 109(1) B.N.S and Section 3/25 of Arms Act, registered at Police Station Para, District Lucknow. 3. The aforesaid case has been registered on the basis of an F.I.R. lodged on 13.06.2025 by a Police Inspector, stating that on the basis of information received from a mukhbir, a police party apprehended the applicant. It is alleged that the applicant started firing gun shots towards the police party. The police fired retaliated shots, due to which the applicant suffered a gun shot injury in his right foot. It is alleged that a country made pistol with an empty cartridge was recovered from the applicant and a live cartridge was recovered from his pocket. A pistol and eight live cartridges were recovered from a bag being carried by the applicant. 4.The applicant's involvement in 14 other criminal cases has been disclosed in para 12 of the affidavit filed in support of the bail application, in all of which, he has been granted bail. 5. The learned A.G.A. has opposed the bail application and he has Versus Counsel for Applicant(s) : Ram Sahay Yadav Counsel for Opposite Party(s) : G.A. Karan Verma .....Applicant(s) State Of U.P. Thru. Prin. Secy. Lko. .....Opposite Party(s) submitted that the allegations have been established during investigation and a charge sheet has been submitted on 07.07.2025. 6. Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that although the F.I.R alleges that the applicant had fired gun shots at the police party but no police party has received any gun shot injury and the applicant himself has suffered a gun shot injury in right foot and that the applicant is languishing in jail since 13.06.2025 whereas the investigation already stands concluded, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail. 7. Accordingly, this bail application stands allowed. 8. Let the applicant- Karan Verma be released on bail in aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to the following conditions: - (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial court.
