Heard learned counsel for the petitioner and learned A.G.A. for the State. This writ petition has been filed by the petitioners for the following prayer :- (i) Issue, a writ order or direction in the nature of certiorari quashing the first information report dated 17.09.2023 lodged in Case Crime No./F.I.R. No. 0548/2023, under section- 323, 504,506 IPC in Police Station- Gomti Nagar, District- Lucknow. A certified and typed copy of First information report dated 17.09.2023 is being annexed as Annexure No.1 to this writ petition. Learned A.G.A. on the basis of instructions dated 17.09.2025 received from Sri Mritunyjay Nath Sharma, Sub-Inspector, Police Station Gomti Nagar, District Lucknow submits that in the present case charge sheet has already been submitted to the Court concerned on 24.04.2024. In view of the above, learned counsel for the petitioner submits that he does not want to press the present petition and prays that the same may be dismissed as not pressed with liberty to avail appropriate remedy. To which there is no objection by the other side. Accordingly, the petition is dismissed as not pressed with aforesaid liberty.
