Order 13/05/2025
[2025:RJ-JP:20175] (2 of 3) [CRLMB-5477/2025]
1. The petitioners have preferred these bail applications under Section 483 of BNSS in FIR No.0074/2025 registered at Police Station-Vidhayak Puri, District-Jaipur City (South) for offences under Sections 308(4), 308(5), 351(3) of BNS, 2023 and Section 66 of the Information Technology Act, 2008.
2. Since all the bail applications arise out of common FIR, therefore these cases are being decided by a single order.
3. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.
4.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in these cases. He further submits that allegations against the petitioners are that they have threatened to kill the Deputy CM through mobile call to ASI posted at PCR Commissionerate Jaipur and also to provide a sim to the main accused-Vikram. He further submits that as far as possessing of the sim illegally, an FIR bearing No.0050/2025, Police Station-Lal Koti, District-Jaipur City (East) has already been registered in which all the petitioners have been enlarged on bail by the trial court on 29.03.2025. He further contended that as per the status report filed by the prosecution, it is very much clear that the main accused is Vikram Singh, who phoned to Police for the purpose as narrated in the FIR. The petitioner-Waseem Khan is behind the Bar since 01.04.2025. The petitioners-Junaid and Mohammed Ashraf are behind the Bar since 29.03.2025. The trial of the case may take considerable time, hence the bail applications of the petitioners may be allowed.
[2025:RJ-JP:20175] (3 of 3) [CRLMB-5477/2025]
5. Learned Public Prosecutor has vehemently opposed the bail applications by stating that in the backdrop of the gravity of offence, bail applications of the petitioners may not be allowed.
6. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, especially the fact that as per status report filed by the prosecution, allegation of giving threatening on phone to kill the Deputy CM is attributed to another co-accused- Vikram Singh but without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.
7. Accordingly, the bail applications under Section 483 B.N.S.S. is allowed and it is ordered that the petitioners- (1) Waseem Khan S/o Mustaq Ali (2) Junaid S/o Mohammad Aarif and (3) Mohammed Ashraf S/o Shri Mohammad Latif shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
