The petitioner has been made accused in connection with Giddi P.S. Case No.22 of 2025 registered for the offence punishable under Section 137(2), 87, 3(5) of the B.N.S., 2023. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention of the co-accused persons kidnapped the minor victim girl to compel her to marry. It is next submitted that the allegation against the petitioner is false. Drawing attention of this Court towards the statement of the victim recorded under Section 180 of the B.N.S.S., 2023, learned counsel for the petitioner submits that therein the victim has categorically stated that she was having friendship with the petitioner and her family members were trying to forcibly get her married with someone else; without her consent and she requested the petitioner to take her somewhere, so that she can continue her studies and she voluntarily left her house. It is then submitted that the petitioner has been in custody since 27.03.2025 as is evident from para-1 of the instant bail application. It is also submitted that the petitioner has no criminal antecedent as mentioned in para-12 of the instant Bail Application. It is further submitted that the petitioner undertakes that he will not annoy or disturb the informant or witnesses of the case in any manner during the trial of the case. It is lastly submitted that the petitioner also undertakes to co-operate with the trial of the case. Hence, it is submitted that the petitioner be released on bail. Learned counsel appearing for the State opposes the prayer for bail of the petitioner. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Hazaribagh in connection with Giddi P.S. Case No.22 of 2025 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and he will not annoy or disturb the informant or witnesses of the case in any manner during the trial of the case.
