This petition has been filed for removing of encroachment on Gata no.65, which is said to be recorded as chak marg. 3. Learned Standing Counsel informs that an order has already been passed on 29.07.2019 for removal of encroachment under Section 67 of the U.P. Revenue Code, 2006, however, against the said order appeal has been preferred by the alleged encroacher bearing Case No. D202410640001833 which is pending before the Additional District Magistrate, Sitapur under Section 67(5) of the U.P. Revenue Code, 2006 and the next date fixed is 29.09.2025. 4. He further states that he does not have any instructions whether there is any interim order operating in the appeal or not. Nevertheless, let the Additional District Magistrate, Sitapur, before whom the aforesaid appeal is pending, decide the same positively within one month of receipt of a certified copy of this order, which shall be communicated by the learned Standing Counsel Shri Raghuvanshi to the said Additional District Versus Counsel for Petitioner(s) : Mukul Kumar Sharma, Mohammad Saem Shiraz Counsel for Respondent(s) : C.S.C., Dilip Kumar Pandey Mohd.Gufran .....Petitioner(s) State Of U.P. Thru. The Prin. Secy. Revenue Govt. Sectt. Lko. And 5 Others .....Respondent(s) Magistrate, Sitapur. Gaon Sabha shall also place copy of the order before him accordingly.
