The present revision has been filed for the following main relief:- "Wherefore, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to allow the revision with cost or may pass any other suitable order with respect to order dated 23-8-2024, passed by Learned Additional Session Judge, Court No.2, Pratapgarh, arising out of Session Trial No. 376/2022, Crime No. 91 of 2021, Under Section- 307,323,504,352 I.P.C., relating to Police Station-Aspur Devsara, District-Pratapgarh, where by the application under section 319 of C.P.C. moved by the opposite party no.2 before Learned Additional Session Judge, Court No.2, District-Pratapgarh with respect to summoning of revisionist, in the interest of law and justice. Revision be allowed." Learned Counsel for the revisionist says that he does not want to press the present revision, the subject matter of which relates to summoning of revisionist in exercise of power 319 Cr.P.C., and he may be permitted to withdraw the present application with liberty to the revisionist to avail benefit of the judgment passed in the case of Satender Kumar Antil versus Central Bureau of Investigation and another, (2022) 10 S.C.R. 351: (2022) 10 SCC 51 and Musheer Alam vs. State of Uttar Pradesh and Another, 2025 SCC OnLine SC 116.. To the aforesaid prayer, learned A.G.A. has no objection. Accordingly, the present revision is dismissed with liberty as aforesaid.
